Smith, 36, was suspended without pay Monday morning, Chief Michael Spears said in a news conference Tuesday afternoon. </p><p> A woman came forward on Aug. 15, telling police Smith had assaulted her while he was on duty. </p><p> Spears would not comment on those allegations, but said that Smith had violated several police department procedures, including IMPD's ride-along policy. </p><p> "He did not devote his full attention to duty. I believe he was in violation of many other of our policies ? and those, combined with the other allegations, which will be forthcoming, were enough information for me Sunday night to make the decision to immediately separate him from employment," he said. </p><p> Spears said a criminal investigation into the sexual assault allegations was under way. </p><p> Smith worked nights with the Northeast District, a post he was assigned to in April of 2007, police said. </p><p> The arrests of several officers this year on charges ranging from running a prostitution ring to selling firearms to felons, drunken driving and drug trafficking have damaged the department. </p><p> Mayor Greg Ballard said Spears took the appropriate action in dismissing Smith. </p><p> "We give him the latitude to do what he thinks is the right thing to do with the cops," Ballard said. "They're seeing it. Melvin Bender Jr., on Hanging Moss Road causing Bender to hit precinct three officer Bobby Nichols, who traveling in the opposite direction. </p><p> Bender was treated for lacerations and a dislocated wrist. </p><p> Nichols was treated and released. </p><p> The cause of the accident is under investigation.   </p><p>Copyright 2008 by WAPT.com. 							PT>                            					<div class="deck11"><strong>Story by <a target=_new href=http://www.wpxi.com/>wpxi.com</a></strong><br /><em></em></div>			<BR />			<div id="intelliTXT">													<p>  BELLEVUE, Pa.   -- </p> <p> Four inmates who escaped the Columbiana County Jail in Lisbon, Ohio, were caught in Bellevue Monday afternoon. </p><p> Before their capture, Columbiana County Sheriff David Smith said that the four male inmates were last seen about 10 miles from the jail sometime around 1:30 a.m. Monday. </p><p> Smith, who was not notified of the escape until 6 a.m., believed the inmates had outside help in their escape. </p><p> The inmates who escaped are Mark Foden and William Merritt, of East Liverpool, Ohio, Jason Heffner, of Salineville, Ohio, and John Hamilton, of Salem, Ohio. </p><p> "I wished we wouldn't have gotten caught," Foden told Channel 11 News shortly after his arrest. "I was looking at 15 years, and I wanted to see my daughter graduate." </p><p> The four escaped by crawling through duct work they accessed in a storage closet, police said. Through the ducts, they were able to reach the roof of the jail where they jumped to their escape. </p><p> Bellevue Patrolman Michael Hudson spotted their stolen getaway car along Crawford Avenue in Bellevue. </p><p> "Fortunately for us, not fortunately for them, they went down a dead end street," Hudson said. </p><p> Police said one suspect fled into some nearby woods but was captured a short time later. </p><p> "They actually acted like they didn't know what was going on until 15 to 20 minutes later when identified as the escapees," said Hudson. </p><p> Officers also arrested Melissa McCuley, 26, the girlfriend of one of the inmates. She was charged with complicity for aiding in the escape. </p><p> The inmates will spend time in the Allegheny County Jail until they can be extradited back to Ohio on Tuesday. </p><p> </p><p> </p><p>Copyright 2008 by wpxi.com. Two researchers on a quest to prove the existence of Bigfoot say that the carcass encased in a block of ice - handed over to them for an undisclosed sum by two men who claimed to have found it - was slowly thawed out, and discovered to be a rubber gorilla outfit.</p><p>The revelation comes just days after a much ballyhooed news conference was held in California to proclaim that the remains of the creature found in the North Georgia mountains was the legendary man-ape.</p><p>Steve Kulls, executive director of squatchdetective.com and host of Squatchdetective Radio, says in a posting on a Web site run by Bigfoot researcher Tom Biscardi that as the "evidence" was thawed, the claim began to unravel as a giant hoax.</p><p>First, the hair sample was burned and "melted into a ball uncharacteristic of hair," Kulls said in the posting.</p><p>The thawing process was sped up and the exposed head was found to be "unusually hollow in one small section." An hour of thawing later and the feet were exposed - and they were found to be made of rubber.</p><p>Matt Whitton, an officer who has been on medical leave from the Clayton County Police Department, and Rick Dyer, a former Georgia corrections officer, announced the find in early July on YouTube videos and a Web site.</p><p>"Everyone who has talked down to us is going to eat their words," Whitton said at the time.</p><p>Phone calls to Whitton and Dyer went unreturned on Tuesday. But the voicemail recording for their Bigfoot Tip Line - which proclaims they search for leprechauns and the Loch Ness monster - has been updated and announcing they're also in search of "big cats and dinosaurs. If you see any of those, give us a call."</p><p>On Tuesday, Clayton County Police Chief Jeff Turner said he has not spoken to Whitton but processed paperwork to fire him.</p><p>"Once he perpetrated a fraud, that goes into his credibility and integrity," Turner said. 							PT>                            					<div class="deck11"><strong>The Associated Press</strong><br /><em></em></div>			<BR />			<div id="intelliTXT">													<p>     WHITE PLAINS, N.Y.     -- </p><p>A New York policeman who body-slammed an unarmed woman onto a tile floor, breaking her jaw, has been indicted on a civil rights charge.</p><p>Authorities say Yonkers Officer Wayne Simoes' takedown of Irma Marquez on March 3, which was caught on video, amounted to assault.</p><p>U.S. Attorney Michael Garcia says it violated Marquez's right against unreasonable force from a police officer.</p><p>The video shows Simoes grabbing the woman by the waist, hoisting her in the air and slamming her face-first onto the floor.</p><p>Simoes' attorney did not immediately return a call. 							PT>                            					<div class="deck11"><strong>DAVID SALEH RAUF</strong><br /><em>San Antonio Express-News</em></div>			<BR />			<div id="intelliTXT">													<p><img style="float:right; margin-right:5px;" src="http://images.cygnusinteractive.com/buttons/logo_lexis.gif" /></p>  <p>A Frio County Sheriff's deputy shot and killed a man he was driving to a local hospital Monday after the man allegedly attacked him inside the deputy's patrol vehicle, police said.</p>    <p>Deputy Roger Salinas fired once, striking 19-year-old Andres Gutierrez - riding unrestrained and in the front seat while being driven to a San Antonio hospital for a psychological evaluation - in the left side of his torso.</p> <p>Gutierrez was shot after he allegedly punched Salinas, who was driving north on Interstate 35 approaching Fischer Road, striking the deputy several times in the face, police said.</p> <p>It was "to the point the deputy said he was going to go unconscious," said San Antonio Police Lt. Gabe Trevino, a police spokesman.</p> <p>So Salinas, who police said feared for his life, shot Gutierrez. Salinas's status as a deputy was not released Monday night.</p> <p>Salinas' patrol SUV came to a stop on a median on I-35 at Fischer Road, where SAPD investigators processed the scene into the evening. The city police department is investigating the shooting because it occurred within the city limits.</p> <p>Salinas was taken to University Hospital where he was treated for his injuries, which included a black eye and a bloody mouth, Trevino said.</p> <p>"The deputy is pretty beat up in his facial area," Trevino said.</p> <p>Gutierrez was in custody under an emergency detention, which allows a peace officer to take a person into custody and transport him or her to a mental health facility for an evaluation. He was pronounced dead at the scene of the 3:15 p.m. shooting.</p> <p>It was not immediately known why Gutierrez, who was convicted and sentenced to probation last year for a misdemeanor marijuana possession charge, was riding unrestrained or in the front seat of the deputy's SUV.</p> <p>But Trevino said that decision, based on an initial investigation of the shooting, appears to be consistent with the policy of the Frio County Sheriff's Office.</p> <p>"That's a policy decision on the part of that department," he said.</p> <p>The Frio County Sheriff's Office did not return phone calls Monday.</p> <p>In San Antonio, SAPD spokesman Joe Rios said officers typically place anyone being taken for a psychological evaluation in the back seat of a patrol vehicle, behind a cage. If not, the person is placed in the front seat, where they are handcuffed and secured with a seatbelt.</p> <p>But he stressed: "If there's a cage they're going in the back seat."</p> <p>At his parents home in Pearsall, Gutierrez' family mourned his death.</p> <p>Reached by telephone Monday, his sister said Gutierrez had been involved in a traffic accident a few years ago that left him mentally disabled. MARTIN</strong><br /><em>The Tribune, Mesa, Ariz.</em></div>			<BR />			<div id="intelliTXT">													 <p xml:lang="en-US">     Shouting and applause spilled out of a tiny Chandler courtroom on Friday as a veteran city police sergeant was acquitted on an animal cruelty charge in the death of his police dog.</p> <p>     Sgt. Tom Lovejoy and his family passed around hugs and handshakes after Justice of the Peace Sam Goodman made his ruling, bringing an end to almost exactly one year of turmoil and uncertainty in their lives.</p> <p>     "It's over," said Lovejoy's wife, Carolynn, as they accepted congratulations from more than a dozen police officers who attended the trial. "It's over."</p> <p>     The judge's ruling was confirmation of what Tom Lovejoy and his defense attorney, Robert Kavanagh, said all along -- that forgetting the dog inside a hot car last August was a mistake, not a crime.</p> <p>     "You forgot," Goodman told the sergeant before revealing his verdict in the packed San Tan Justice Court. "Everybody here heard that and I believe it."</p> <p>     Maricopa County prosecutors accused Lovejoy of reckless animal cruelty, a misdemeanor, in the Aug. 11, 2007, death of his K-9 partner Bandit.</p> <p>     Lovejoy forgot to take Bandit out of his police vehicle after coming home that morning from an overnight off-duty job. He got very little sleep during the two previous days, and was juggling a number of family and work issues when he went inside his house.</p> <p>     The dog ended up stuck inside the vehicle for nearly 13 hours while temperatures outside peaked above 100 degrees.</p> <p>     When Lovejoy discovered the dog that night, the 5-year-old Belgian Malinois was long dead from heat stroke.</p> <p>     The judge assured Lovejoy that his busy and tiring schedule, which arguably caused him to forget about the dog, was not unusual.</p> <p>     "They're just the everyday things of life." Goodman said.</p> <p>     Prosecutor Lisa Aubuchon, a tough and high-ranking lawyer in the Maricopa County Attorney's Office, spent the morning trying to show Lovejoy as a man distracted.</p> <p>     She painted a picture of him spending the day gabbing on his cell phone, shopping at the mall, napping at home and dining out, all while his police dog baked to death.</p> <p>     "Common sense" and training, she said, meant Lovejoy was well aware of the risk of forgetting his dog.</p> <p>     Kavanagh, however, made the case that the situation was more nuanced and complicated than that.</p> <p>     One of the people who took the stand was a Tempe psychologist who examined the facts of the case, talked to Lovejoy and determined he was suffering from circadian sleep disorder, a type of sleep deprivation.</p> <p>     Many police officers suffer from similar sleep disorders without knowing it, psychologist Stephen Carson said.</p> <p>     "They're highly devoted to what they're doing and it just creeps up on them," Carson said. "It's insidious."</p> <p>     Some of the most compelling testimony of the daylong trial came when Shane Murphy, the sergeant's 20-year-old stepson, talked about being inside the house when Lovejoy discovered Bandit dead outside.</p> <p>     "We heard what I can only describe as a wailing," Murphy said. "It was terrible. All I could hear from Tom is, 'Oh my God. Oh my God. I forgot my dog.'"</p> <p>     One of Lovejoy's young daughters came into the house also wailing. The family was in shock over the whole thing, Murphy said.</p> <p>     Lovejoy took the stand near the end of the day. He talked about being with the Chandler Police Department for 17 years, working his way up the ladder, and having a close bond with Bandit, whom he considered his partner.</p> <p>     He also recalled the hours before he left Bandit in the vehicle, how he fell back to sleep after being called out to search for a rape suspect, how he was feeling sick and how there were other demands on his time that day.</p> <p>     He said he knows he is the only one to blame for his own exhaustion and his dog's death.</p> <p>     "I just took on too much," Lovejoy said, "and I let things go, I was so tired, and my mind wasn't working."</p> <p>     After the trial, Lovejoy stood outside the courthouse, just across the street from police headquarters, with his arm around his wife.</p> <p>     He joked with reporters and lashed out against prosecutors and the Maricopa County Sheriff's Office, which investigated and arrested him after his own department cleared him of any crime.</p> <p>     He particularly hit hard against Sheriff Joe Arpaio, who held a press event last September to publicize the arrest.</p> <p>     "He held me accountable for the charges," Lovejoy said. "Now I think it's safe to say it's time for him to be held accountable."</p> <p>     Arpaio's office declined multiple requests to comment.</p> <p>     Aubuchon declined to comment following the trial.
